He was claimed from the race by trainer Eliska Kubinova on behalf of Gary and Deborah Lusk and remains their property because Arizona does not have a voided claim rule. Claims are considered valid once a horse leaves the starting gate."

The trainer was handed a 180 day suspension.

The ruling was also forwarded to the director of the Arizona Department of Racing with recommendation for further action "up to and including revocation of license."

Imo, that's the proper action to take. Juan Pablo Silva is not going to be training again anytime soon.

But several things still bother me:

• The fine was only $2500. Imo, way too small if fines are supposed to be any kind of deterrent.

• The incident took place on 03-10-2022.

• The trainer was able to get the original hearing postponed until 03-24-2022.

• During that waiting period, on 03-19-2022 in the Liz Bracken Memorial at Rillito Downs, the same trainer (Juan Pablo Silva) had one break down (Bali Brava at odds of 1-5) on the backstretch.

Ugh.
